General Terms and Conditions (AGB)

Scope of application

Contracts, offers, deliveries and services of Marienapotheke Mag. pharm. Wolfgang Stindl jun. e.U., hereinafter referred to as Marienapotheke Perchtoldsdorf, are based exclusively on these General Terms and Conditions. The General Terms and Conditions shall be deemed to have been accepted by the customer upon placing the order for the goods.

The General Terms and Conditions may be amended at any time. The version valid at the time the customer's order is received by Marienapotheke shall apply.

Conclusion of contract

All offers and information on offers are subject to change and non-binding with regard to the provision or availability of the goods. This provision applies to all information in our price lists, advertisements, advertising material, information texts of any kind as well as verbal and telephone information and promises, subject to editorial errors, printing errors or incorrect information due to faulty electronic data transmission.

A contract is only concluded when the order is accepted. The order is generally placed by order confirmation by telephone or electronic order message or upon delivery of the goods.

For deliveries to a delivery address outside Austria and Germany, the customer will receive an offer for the desired products by telephone or e-mail, which includes the prices of the ordered goods and the transportation costs. In this case, the contract is only concluded upon acceptance of the offer by the customer.

The contractual service comprises either the delivery of the ordered goods to the specified delivery address or the provision of the goods in the Marienapotheke Perchtoldsdorf.

Prices and validity

The prices quoted are gross prices in euros and include all statutory charges (e.g. VAT). In particular, all costs incurred in the course of shipping and possible import costs are not included. Information on the prices of medicinal products takes into account the statutory provisions (Price Act, Austrian Pharmaceutical Tax, maximum mark-ups in the wholesale pharmaceutical trade).

The list prices of the day on which the order is received by Marienapotheke Perchtoldsdorf apply. The prices are daily prices and are valid from midnight to midnight.

If you pre-order medicines or products for collection from the pharmacy and have a valid prescription from a health insurance fund or a prescription approved by a doctor, the prices are for information purposes only. You will of course only pay the current prescription charges.

Terms of payment and retention of title

The goods shall remain the property of Marienapotheke Perchtoldsdorf until all claims against the customer in connection with the respective order have been settled in full.

Payments must be made within 14 days of the invoice date.

Payments can be made by cash in advance (bank transfer), KLARNA instant bank transfer, credit card (VISA, Mastercard), EPS.

In the event of late payment, reminder fees of up to EUR 6.18 per reminder and default interest of 12% p.a. as well as the appropriate collection costs in accordance with the Collection Fees Ordinance may be charged.

Terms of delivery

For certain goods, i.e., in particular, manufacturing or procurement from Germany and abroad, we shall inform the customer of the extended delivery time. The type of shipment will be determined at our discretion. Ice and refrigerated goods and other goods with difficult delivery conditions can only be delivered at the discretion of Marienapotheke Perchtoldsdorf and after consultation.

The customer will be informed immediately of any delays in delivery. However, they release us from the promises made.

The following applies for delivery in AUSTRIA:

Deliveries by home delivery are made within 4 working days (standard delivery time, not guaranteed) after acceptance of the order by Marienapotheke Perchtoldsdorf or after receipt of the payment confirmation, if payment is made by credit card. If the customer collects the goods from Marienapotheke Perchtoldsdorf, the goods will be available for 12 days after acceptance of the order.

The following prices apply for delivery:

  • Delivery throughout Austria is free of charge from a gross price of EURO 100.00.
  • For delivery to the rest of Austria up to a gross price of EURO 99.99, EURO 4.50 incl. 20 % VAT will be charged additionally.

The following applies to deliveries to GERMANY :

Deliveries by home delivery are made within 8 working days (standard delivery time, not guaranteed) after acceptance of the order by Marienapotheke Perchtoldsdorf or after receipt of the payment confirmation, if payment is made by credit card.

The following prices apply for delivery:

  • Delivery throughout Germany is free of charge from a gross price of EURO 100.00.
  • Up to a gross price of EURO 100.00 EURO 6.90 incl. 20 % VAT will be charged additionally.

Resignation

The customer has the right to withdraw from the contract within 14 working days of delivery of the goods. Withdrawal from the contract must be notified to Marienapotheke Perchtoldsdorf in writing. The costs for the return shipment shall be borne by the customer.
